Important Notice
THESE TERMS APPLY SPECIFICALLY TO NUWATT ENERGY'S SERVICE OF SOLAR ENERGY SYSTEMS ORIGINALLY INSTALLED BY A THIRD-PARTY COMPANY THAT IS NO LONGER IN BUSINESS ("ORPHANED SYSTEMS"). BY REQUESTING SERVICE, YOU ACKNOWLEDGE THAT NUWATT ENERGY DID NOT INSTALL YOUR ORIGINAL SYSTEM AND HAS NO PRIOR KNOWLEDGE OF ITS INSTALLATION QUALITY, HISTORY, OR CONDITION. THESE TERMS SUPPLEMENT NUWATT ENERGY'S GENERAL TERMS OF USE.
1. Scope of Service
NuWatt Energy will perform only the specific repairs, replacements, or services described in your written scope of work ("Work Order"). By accepting a Work Order, NuWatt Energy does not assume responsibility for the overall condition, performance, or safety of your entire solar energy system.
Service is limited to the components and tasks explicitly listed in the Work Order.
Any additional work discovered during service requires a separate written authorization and estimate.
NuWatt Energy does not adopt, assume, or extend any warranties or obligations of the original installer.
2. Pre-Existing Conditions
By requesting service, you acknowledge and agree that:
Your solar energy system was installed by a third-party company that is no longer in business.
NuWatt Energy has no knowledge of or responsibility for the original installation quality, materials used, design decisions, or compliance with codes and standards at the time of installation.
Pre-existing defects, code violations, substandard workmanship, improper wiring, inadequate structural attachments, or other issues from the original installation may exist that are not apparent during a standard diagnostic.
NuWatt Energy is not responsible for any damage, loss, or injury resulting from pre-existing conditions, whether or not those conditions are discovered during service.
3. System Assessment Limitations
NuWatt Energy's diagnostic inspection identifies issues that are visible, testable, or reasonably discoverable at the time of inspection using standard industry tools and methods. You acknowledge that:
A diagnostic inspection is not a comprehensive engineering evaluation or code compliance audit.
Hidden defects may exist within walls, beneath roofing materials, inside conduit, or in other inaccessible areas that cannot be detected without invasive investigation.
Intermittent electrical faults, degraded insulation, or thermal cycling damage may not present symptoms during a single inspection.
The diagnostic report represents conditions observed at the time of inspection only and is not a guarantee that all defects have been identified.
4. Warranty Limitations
NuWatt Energy's workmanship warranty applies exclusively to the specific repair or service performed, for the warranty period stated in your Work Order.
The warranty covers only NuWatt Energy's labor and workmanship on the specific components serviced.
The warranty does NOT extend to the entire solar energy system, unserviced components, or components installed by the original installer.
Manufacturer equipment warranties (panels, inverters, optimizers) are between you and the manufacturer. NuWatt Energy can assist with warranty claims but does not guarantee manufacturer warranty coverage.
No warranty is provided for systems where the customer declines recommended repairs or where pre-existing conditions contribute to subsequent failures.
5. Known Deficiency Disclosure
If, during the course of service, NuWatt Energy discovers additional problems, safety hazards, or code violations beyond the original scope of work:
NuWatt Energy will document the findings in writing and provide them to the customer.
A separate estimate for corrective action will be provided if applicable.
If the customer declines the recommended corrective action, NuWatt Energy assumes no liability for damage, loss, or injury resulting from the known but unaddressed deficiency.
The customer's acknowledgment of the disclosed deficiency will be documented.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
NUWATT ENERGY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM RESCUE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
NUWATT ENERGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, LOST ENERGY PRODUCTION, ROOF LEAKS, ELECTRICAL FIRES, OR PERSONAL INJURY ARISING FROM PRE-EXISTING CONDITIONS OR UNSERVICED COMPONENTS.
THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
7. Customer Responsibilities
As a condition of service, you agree to:
Maintain active homeowner's insurance that covers your solar energy system and property.
Provide safe and reasonable access to the solar system, electrical panels, and related equipment.
Disclose all known issues, previous repairs, modifications, or concerns about the system.
Provide any available documentation from the original installation (permits, plans, manuals, warranty cards).
Promptly report any new issues or changes in system behavior after service is completed.
8. Indemnification
You agree to indemnify, defend, and hold harmless NuWatt Energy, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from or related to: (a) pre-existing conditions of your solar energy system; (b) your failure to disclose known issues; (c) your decision to decline recommended repairs or corrective actions; or (d) damages caused by components not serviced by NuWatt Energy.
9. Governing Law
These Rescue Service Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising from these terms or the services provided hereunder shall be resolved in the state or federal courts located in New Hampshire.
